I am happy to write that today I received my first emailed receipt notice for a FY 2010 H-1B application and that then, about 5 hours later, I received an emailed approval notice in the same case. The I-129 was a U.S. Masters Cap case that was premiumed processed with the Vermont Service Center.
I will update this site as I receive word on my other FY 2010 H-1B cap cases.

What a chaos? We were so close, turned out to be mirage. When do you expect your GC? My PD is Feb 2006. I do not expect anything positive in 3 years. I doubt anything changed in our career in 2 years. Where do we stand?

My details:
India/EB3/PD:Sep2003/I140 Approved.
I485/EAD/AP: Recevied July 28
I completed FP appointment last week (Wednesday), but LUD has not changed since then.
Also EAD status changed twice (before undergoing FP) it said Card Production Ordered. Today it changed to Approval Notice sent.
Questions:
1. Is there any relation between FP and EAD ? (e.g. Prints appear on EAD etc)
2. Is that the right sequence in change of status:
"Card Production Ordered" followed by "Approval Notice Sent".

I need feedback from you guys. I have researched this lawyer before I got her to start my greencard and the feedbacks seems that she is efficient and knowledgeable. However, since we signed the contract with her, things have been moving so slow. She doesn't want to talk to me or give me status updates when asked. She has all the information needed from me and my employer to start the prevailing wage request but a month has passes and nothing has been requested yet. Has anybody here experience the same thing?

The Cap seem to be moving slowly in the past few months, but something is different with the release of the new count this week.
As of September 18, 2009, approximately 46,000 H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. It seems that some employers are hiring again and willing to file for H1B visas for specialty workers. This is a good sign, but this also means that visas may run out sooner than expected.
USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

Hello All,
I received a "Notice of intent to Revoke " on my approved I-140 recently. By gods grace, my company was able to get my I-140 reaffirmed.
The status on the USCIS website states as follows.
".....we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly."
We did NOT request for consular processing. Does any one know why USCIS send my case to Department of State?

Can people convert LC pending in BEC to PERM? If So, how safe it is and how much time it takes totally.
Yes, and its well known. Talk to or just visit Murthy or Immigrationportal and you will find lot of discussion on this topic. In a nutshell, as long the PERM application is identical to BEC pending application you can convert to PERM. Make sure to find an attorney familiar in such type of cases.

What is the best way to save one from going out of status on E-3 visa?Can a E-3 Visa holder or E-3D visa holder may apply and successfully get EB-3 or EB-2 green card?Can E-3 visa holder may work for two employers (already USCIS approved extension petition from both) simultaneously (without filling any new I-129 or extension request)?
The place of birth for E-3 Visa holder is Pakistan.
Please suggest and advise?

My employers are considering transfering me to another group company (different name) during the next 1-2 months. My job profile will remain unchanged, but the employer name/address (on paychecks, etc) will be different after the transfer. My I-140 is still pending (filed in Aug 2007 together with I-485 at NSC under EB-3).
I'd greatly appreciate anyone's advice on the following:
a) If I transfer before my I-140 is approved, do I need to notify USCIS in writing? If so, does any specific paperwork need to be filled out? My employers have assured me they will continue to support my I-140/485 under the original company name, for as long as required.
b) If I transfer after approval of I-140 (fingers crossed!), do I need to notify USCIS? Again, is any specific paperwork necessary?

You need to get a copy of 140, so you may have to tell your employer about your AC21 (actually no need if you have a copy of approved 140). Nothing to get scared of. But its good to leave in good terms.
Once you start using EAD your H1 will get cancelled anyway. So it wont make any difference if your old employer cancels it.
