I have an issue with my recent H1B approval on Feb'2010. I am seeking your advice in this regard.
I have been in H1B since 11/01/2005 , entered US on 04/20/2006 and my PERM has been already approved with a PD of 03/15/2009. My current I 94 is expiring on 4/13/2010. Recently I got an H1B extension approval of just 1 year (4/13/2010 to 4/13/2011) , which is less than actual 6 years with approved PERM.
Do you think that any appeal or ammendent can be done to extend the approval period? With my H1B petition I had to enclose a client engagement letter which confirmed my engagement but didnt have any engagement end date there.
If you think that any appeal or ammendent can be done with USCIS, then kindly advise me accordingly. Thanks

The US Chamber of Commerce is seeking a review by the nation's highest court of the Arizona law that calls for the revocation of business licenses for employers found to have knowingly hired illegally present immigrants and also mandates all employers in the state use E-Verify. The case could settle the basic question of what authority a state or local government has in regulating immigration.

All too often, it seems that some examiners at USCIS Service Centers are just looking for a way to deny petitions. Long-standing policies are ignored and new theories are advanced to deny perfectly-qualified applicants for immigration benefits. A few months ago, a few examiners decided on their own that M.B.B.S. degrees which are issued to physicians from British Commonwealth countries were not equivalent to M.D. degrees issued by medical schools in the U.S. As a result, many petitions and applications were denied on this basis. After much protest from the medical community, the USCIS in Washington got involved, and the...

Hi,
If a H1B visa holder is in US, i know it is possible to transfer H1B to a different comapny in US. But can anyone help me understand if the same is possible if the person having the H1B visa is in india currently?
Details
Using H1B visa, the person has worked in US for first 3 years. Now the person has applied for H1B extension and still the petition papers have not yet come. After applying extension the person has gone back to India. The person's current company is hesitating to send him back to US.
Question
After getting the petition papers, can one transfer H1B visa to a different company staying in india itself and them come to US via new comapany?
Thanks in advance.

[Blogger's Note: With the surrender by Lou Dobbs last Wednesday of his role at CNN as an anti-immigrant advocacy journalist, and his refusal to rule out a run for political office, It's time to reprise my reasons for blogging about our nation's dysfunctional immigration policies, first published on October 24, 2004. Despite the passing years, the message has muscular legs.] This is the first posting to a new public-policy blog with a name that must be a typo: www.nationofimmigrators.com. Surely this blogger means to write Nation of Immigrants, not Immigrators. No; theres no mistake. We are all Immigrators. We, the...

Wendy Sefsaf of the Immigration Policy Center makes the case that the answer is no. And she also lays out the evidence that legalizing those workers would actually raise wages for US workers and contribute to economic growth that will result in more job creation.

Hello everyone,
I obtained my F1 visa in Aug,2001 for 5 years and I initially came here for M.S. I have continued for PhD in 2003 and visited India every two years. My F1 expired in Jul,2006 but my I-20 is valid until Dec,2008.The real problem is that I have applied for Canadian PR this Oct and expecting to get it by Oct,2008.
Once I get my PR, I have to go to Canada for Visa stamping and my questions are related to this:
1) Since my F1 expired, Can I come back to US after PR stamping, without needing an F1 visa.?
2) Is it advisable to get my F1 visa stamping in India or Canada next year i.e in Oct 2008, or would it be too late? (since that would be two years after visa expiry).
PS: I wanted to get my F1 stamping only if it were necessary to go to India.
Any suggestions would help me a lot and thanks so much in advance.

Guys..
I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. Thanks as always...

I read this in the I-485 application:
"The check or money order should be made payable to the Department of
Homeland Security except:
--If you live in the U.S. Virgin Islands and are filing this
application freely, make your check or money order
payable to the ''Commissioner of Finance of the Virgin
Islands.''
--If you live in Guam and are filing this application there,
make your check or money order payable to the
''Treasurer, Guam.''
Good luck in re-filing!
Should the check made out to "Department of Homeland Security"?
Should the checks stapled with each form (485, 131, 765) or kept on top of the packet?

Is it possible? Pro-active Finger-Printing without appointment letter.
I have done my FP on March 1st 2005, since the validity is now expired, i called the VSC to enquire when and if i will be getting another FP notice soon. She told me that i can contact the local ASC(Application service centre) and go for the Finger-printing without any formal Notice/Appointment Letter.
Has anybody done this? ie has anybody done Pro-active finger-printing without appointment letter? Please reply.
Regards.
