    USCIS can't keep track of applications they receive..:)
    Every document they want they "REQUEST" from you.
    W2, paystubs this is basic stuff dude..
    If you don't have them, there's less certainity.. but this is funny process, people have gone thro' easier on lesser evidence.. !So nothing is a dead-ender if you are lucky..
    In normal cases though.. I think IF (and that's a big IF) you get an RFE, you will have hard time proving A2P but then again maybe your employer is big and has enough profits etc to prove A2P .. so don't loose heart.. but I would advise to just change to a good employer instead of working in this messy situation to get 1 or 2 yrs advantage on PD

    does anyone know to whom should i report the issues i have with my previous employer?
    it is regarding the salary and unpaid dues..

    Unless you specifically say what your status is, what the dues are for, the agency that could help you cannot be determined.

    State Labor Department, US DOL Wage and Hour division or a civil/small claims case are your options depending on your state laws.

    Hi,

    I recieved my EAD card recently and noticed that the date of birth on the card is not correct(I filled the application incorrectly the montha day got swapped),can you please suggest on what i have to do to correct the date on the card.

    Take infopass and speak with I/O in this regard.I think you will need to refile and pay fees again as it was your mistake on the form.

    Wish you all the best. It is too late to learn that one should not leave everything to the lawyers. Accuracy of info, signatures, etc. need to be thoroughly checked by us, the filers. Lawyer is doing this work for several people, and they want to spend least time on each. We, understanding the impact, are prepared to spend little extra time for checking thoroughly.

    What tactical explanation is he going to give? May be he should say that it was signed but USCIS guy did not see it. Or, ink was bad, and evaporated, etc. "Fogot" will be difficult to make them accept.

    No Idea how is he going deal..I will try my best to avoid...any further issues.

    I don't have access to cover letter and in the other document which "Application for Alien Employment Ceritification" belong to US Dept of Labor, i'm seeing "dates forms received, Ind Code,occ code, Occ title"....in the BOTTOM RIGHT corner ....

    This is where our problem lies. People once they are greened completely forget the troubles and "never ever" look back. Many of us (either directly or as dependents) have been greened and have reached very high positions but never feel the need to help out. I am wondering whether it is because we have failed to ask their help??
    Instead on focussing on senators and congressmen/women (which IV members are already doing) would it be worthwile to prepare a list of influential (political, business, scientists) immigrants (particularly chinese and Indians) and then getting their help/input to our cause??

    First people who do not have greencard should support.
    Right now we do not even have 1% of those people part of IV

    Hello All,

    I am currently on OPT which is valid till July 2009. Also, my H1-B is approved through a company X starting oct 2008. Currently I got a job with company Y on my OPT. Can I continue to work on my OPT with company Y till July 2009? OR Do I need to transfer my H1B to company Y from company X to be able to continue to work after Oct 2008? If so, do I need any paystubs from company X. What can be the start date on the offer letter from company X.

    Please help. Your guidance is truly appreciated.

    I believe that the I-94 attached to your I-797 (H1-B approval notice) will terminate your F1 status (OPT). In that case, from Oct 1, 2008, you must have an H1-B (or other work visa) to work for a company. Simply ask company Y to file for H1-B and attach your I-797 that you got from company X with it as a proof that you have been counted towards the quota.

    The paystubs are needed as a proof of continuing employment in H1-B (i.e., proof of valid H1-B status). Since you have not yet started your H1-B, that is not required.

    Has anybody done that?
    Questions;
    1) Will the old 140 be valid (for using the PD) even if the old employer withdraws/revokes the old LC/140? Big corporation, so I thought that would be a standard procedure?
    2) Has the new job title and responsibilities be very similar to the old one?
    3) Has the new LC/140 to be filed before the old one is cancelled inorder to keep the PD?
    4) is there any memo/law that allows us to keep the old PD once a 140 has been approved (even if it is revoken)?

    It is clear that a new LC/140 has to be done once you change the job. So any other information is welcome.

    Not sure now, but back in 2007-2008 they did file EB2, I have 2 friends on eb2 waiting to get their GC. one is already left Oracle after 180 days of I-485 filing and another is still working.

    Not to scare you just for your info which I heard in rare case if oracle lays off they don't care which stage of your GC process is in.

    Then again I presume it would involve paying a fee of $80 for the biometrics too each time you apply online. Could be avoided if we go paper based.

    That does raise a small question here, the $1010 fee that we pay does that also exempt us on the biometric fee, so in essence AP/EAD/FP is all exempt irrespecitve the number of times we apply under the new fee structure?

    I think the Biometrics fee should be covered....when we applied online...the biometrics fee was part of the entire AP fee...we didn't pay a separate fee. It doesnt make sense that just because you apply online, you have to go for biometrics but if you send a paper application, they would not require biometrics! What does the application method have to do with biometrics? I suggest you call up USCIS and confirm about the biometrics fee...but as far as I know...everything should be covered with the fee your wife paid during the AOS application..

    140 APPROVED.

    In addition to the first RFE as above,i received one more RFE.In the second RFE they mentioned that education and experience satisfies labour,but wanted more documents from company to prove A2P.Company sent tax returns and got the approval in 6 days.Yet to receive the notice.


    Good luck to all waiting for approval.

    One has to pay taxes on worldwide income if filing taxes as US resident. He/she can deduct foreign taxes paid as credit. It does not matter if income is taxed or not in the foreign country.

    This is correct. I went to USPS a couple days ago. If I fill out the inquiry form and send it in to USPS headquater, they will track it. If it is cashed, they'll let me know who cashed it. If it is not cashed 60 days from when you first bought the money order, USPS will refund the money to me.

    The problem for us is: given the chaos and delay in the immigration process, we cannot be sure the USCIS cashes the check within 60 days of receiving it. If we file inquiry for the Money Order with USPS, we risk canceling the MO before USCIS can cash it. Then our case is screwed...

    I hate USPS... They should have offered the option to seperat simple inquiry and request of refund... I cannot believe this sh&*&*!:mad:

    Good luck to us anyway. Next time, use your personal check or MO from your bank...

    The way you track money orders is , after 30 days from the date u gave them out , pull out the Money Order Sequence "Number" at the bottom of the top slip that you have. Give that in along with $5 to your local post office. they would track it for you and give a report.

    CAREFUL though. USPS , when it goes to track the MO, if it has not been cashed, they will give back the value on that MO (say the face value of the MO is $500 , if un-cashed , they give u $500 ). So, the person intended to cash it cannot.

    If cashed they give you the person's ID who cashed it.

    So, wait for a while before you invoke the process.

    My company has filed an AOS application on July 02 2007 using an approved EB3 I-140 (PD = Sep 2001). Then in Dec 2007, they have filed a EB2 I-140 using an approved EB2 PERM to convert the pending AOS apllication to EB2, hoping to port the priority date of pending AOS application to EB2 Sep 2001. EB2 priority dates were retrogressed after the EB2 I-140 was filed.

    I am thinking of switching the job now. I don't expect USCIS to process the EB-2 I-140 for next 6 months or so. Is it safe to switch jobs in this situation? I have portability right now, since 180 days have passed after the AOS application was filed with EB3 I-140. Does the EB2 I-140 adversely affect the AC21 after I join the new employer. What will happen to my pending AOS application, when USCIS processes the EB2 I-140 from my original employer, before or after I have used AC21 from the new employer.

    Appreciate your feedbacks on this.

    Hi, Looks like several of us have got glitches here and there on the I 485. As I mentioned in my post, the customer service persons at CIS told me to make correction after getting the receipt.

    I suggest that each of us call the customer service just to verify whether the responses are consistent. I called 2 times and the responses were largely consistent.

    The rationale for this proposed strategy is that customer service people sometimes are impatient and really do not answer questions appropriately. This seems to be a common problem with over-the-phone customer service.:mad:

    EAD was approved on August 11th and I got the card in mail couple of days after I received the email. But, I haven't received the approval notice for my EAD yet. The status on the EAD shows that the approval notice was sent on August 13th. I had no issues with AP though.

    Am planning to apply paper based AP, can you give the list of docs required for the same.

    I did check the USCIS website for the July 17, 2007 (reinstating the July Visa Bulletin) and July 23, 2007 (about I-485 fees) notices that are specified on murthy.com link you provided, but did not find them. So if any of you know how and where to get them from please let me know. Appreciate your help. Thank you.
